Terms of Service

1. Scope and Beta Notice

These Terms of Service ("Terms") govern the use of the camera calibration software and related services (the "Service"), provided free of charge by Hauke Brunken, a private individual ("Provider"). By using the Service, you agree to these Terms.

Beta notice: The Service is offered in a testing and evaluation phase ("Beta") solely for evaluation and research purposes. It is not certified or approved for use in operational, production, or safety-critical systems. Features and availability may change or the Service may be discontinued at any time; uninterrupted or error-free operation is not guaranteed.

All outputs — including intrinsic parameters, distortion coefficients, and visualisations — are algorithmic estimates. They are not certified measurements and do not constitute professional engineering advice. Statutory warranty rights remain unaffected.

2. Validation and User Responsibility

  • Mandatory independent validation: All calibration outputs must be independently verified, validated, and tested by qualified engineers before deployment in any operational system.
  • You are solely responsible for integrating outputs into hardware, vehicles, robotics, or other products, and for compliance with all applicable laws, regulations, and safety standards.
  • The Service does not replace professional system-level validation, safety engineering, certification, or regulatory compliance processes.
  • Where damage results from the deployment of outputs that were not independently validated, Provider's liability is reduced accordingly pursuant to § 254 BGB (contributory negligence).

3. Limitation of Liability

Provider's liability is unlimited for damages arising from: (i) intent or gross negligence; (ii) injury to life, body, or health; or (iii) claims under mandatory product liability law.

For damages caused by slight negligence, Provider's liability is excluded unless the obligation breached is essential to achieving the purpose of this agreement (wesentliche Vertragspflicht). Where such liability arises, it is limited to the foreseeable, contract-typical damage.

As the Service is provided free of charge for testing purposes, the foreseeable, contract-typical damage is inherently limited.

4. Acceptable Use

When using the Service, you must:

  • comply with all applicable laws and regulations;
  • not present the Service or its outputs as certified, safety-approved, or professionally validated;
  • not interfere with or disrupt the operation of the Service or its infrastructure;
  • not upload images or data that infringe the rights of third parties or violate applicable law;
  • not upload images that show identifiable persons or otherwise contain personal data (e.g., faces, licence plates). Calibration images should show only the calibration pattern and its surroundings.

Provider may suspend or terminate access to the Service at any time without stating reasons, in particular in case of a breach of these Terms.

5. Data and Privacy

You retain all rights to uploaded data. Provider processes data solely as necessary to deliver the Service, in accordance with the Privacy Policy.

6. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Mandatory consumer protection provisions and applicable EU data protection law — in particular the GDPR — remain unaffected.
